14th- and 17th-Placed Nottingham and Everton Guilty for Breaching Premier League Rules on Profitability and Sustainability

Earlier this week, charges over breaching the Premier League rules on profitability and sustainability have been slapped on Nottingham Forest and Everton, two teams at the bottom half of the English top-flight football in the 2023/2024 Season. As confirmed by the English Premier League itself over assessments up to and including the last season, the currently 14th and 17th-placed Forest and Toffees violated the Premier League rules on profitability and sustainability on their suffered losses that went beyond the league’s allowed threshold, and these teams are set to face huge point deductions at this mid-period of 2023/2024.

The end result could see both English clubs relegated to the second tier of the English football league system, the English Football League Championship, at the end of the season.

 

The League’s Statement on Nottingham and Everton Breaching the Premier League Rules on Profitability and Sustainability

The official statement released on the two clubs that have breached the Premier League rules on profitability and sustainability by the English Premier League read: “Everton FC and Nottingham Forest FC have each confirmed to the Premier League that they are in breach of the league’s Profitability and Sustainability Rules (PSR). This is as a result of sustaining losses above the permitted thresholds for the assessment period ending season 2022-23. In accordance with Premier League rules, both cases have now been referred to the chair of the judicial panel, who will appoint separate commissions to determine the appropriate sanction.”

The announcement also added: “Commissions are independent of the Premier League and member clubs. The proceedings are heard in private with the commissions’ final decisions made public on the Premier League’s website. The league will make no further comment until that time.”

The charges over Forest and Toffees have been sent to the chair of the independent judicial panel, and separate commissions will be designated to determine the appropriate sanction; The previous penalisation of such an offence over breaching the Premier League rules on profitability and sustainability was a 10-point deduction given to Everton earlier this season.

Everton’s Announcement on Breaching the Premier League Rules on Profitability and Sustainability

Everton, who only just managed to escape the relegation zone upon hard work after their 10-point deduction on another occasion, had this to say about their latest charges of violating the Premier League rules on profitability and sustainability: “Everton Football Club acknowledges the Premier League’s decision to refer a breach of Profit & Sustainability rules (PSR) for the assessment period ending with the 2022/23 season to an independent Premier League commission. This relates to a period which covers seasons 2019/20, 2020/21, 2021/22 and 2022/23. It therefore includes financial periods (2019/20, 2020/21 and 2021/22) for which the Club has already received a 10-point sanction. The Club is currently appealing that sanction.”

Toffees also mentioned: “The Premier League does not have guidelines which prevent a club being sanctioned for alleged breaches in financial periods which have already been subject to punishment, unlike other governing bodies, including the EFL. As a result – and because of the Premier League’s new commitment to deal with such matters “In-season” – the Club is in a position where it has had no option but to submit a PSR calculation which remains subject to change, pending the outcome of the appeal.”

“The Club must now defend another Premier League complaint which includes the very same financial periods for which it has already been sanctioned, before that appeal has even been heard. The Club takes the view that this results from a clear deficiency in the Premier League’s rules. Everton can assure its fans that it will continue to defend its position during the ongoing appeal and, should it be required to do so, at any future commission – and that the impact on supporters will be reflected as part of that process,” concluded the club who are only a point above the relegation zone at the moment.

Forest’s Words on Breaching the Premier League Rules on Profitability and Sustainability

Nottingham Forest, on the other hand, released a much shorter announcement on them being charged for breaching the Premier League rules on profitability and sustainability. They said: “Nottingham Forest acknowledges the statement from the Premier League confirming that the club has today been charged with a breach of the league’s Profitability and Sustainability Rules. The club intends to continue to cooperate fully with the Premier League on this matter and are confident of a speedy and fair resolution.”

What About Manchester City’s 115 Charges?

As soon as the verdicts were out on Nottingham Forest and Everton on their charges for breaching the Premier League rules on profitability and sustainability, all eyes turned to the three-time defending champions Manchester City over their 115 violations of the Premier League’s spending rules. The outcome of these charges will take a much longer time to come to a conclusion, since the nine seasons involved fell outside the timeframe of the Premier League’s new rules and the case is much more complicated than that of Forest’s and Everton’s.

 

Can Forest and Everton Survive Relegation From the Possible Point Deduction?

The heaviest punishment penalised by the league over breaches on the Premier League rules on profitability and sustainability was the 10-point deducted given to Everton earlier in the 2023/2024 Season. Should both Forest and Toffees be demerited with similar discipling, then they will be left with 7 and 10 points with 17 and 18 games to go in the remainder of the current season respectively. It is likely to be a mission impossible for both teams to stay in the English top-flight football as the average point total needed to survive the Premier League relegation battle is at 38 points.
